Evidence

There are many reasons why you shouldn’t delay contacting an attorney following an accident.  One reason is that you might lose evidence.  If you were involved in a motor vehicle accident, there may be skid marks left on the roadway that may be washed away by the rain or other weather conditions.  That evidence could be crucial to your claim.  Another reason is that there may be witnesses to the accident that may move away, change phone numbers or other situations that may make it impossible to track them down as time passes.  

Statute of Limitations

There is a time limit for filing a claim called the statute of limitation. In Kentucky, if you are unsuccessful in settling your motor vehicle accident claim with the liability insurance carrier, you have two years to file a lawsuit in the county in which the accident occurred.  

Statute of limitations are not the same for all types of cases.  For instance, a slip-and-fall accident carries a one-year statute of limitations in the state of Kentucky.

Once your statute of limitations expires, you are forever barred from receiving any type of compensation for your injuries.
